The Struggle against Profiteering at the Last Period Money Markets of the Ottoman Empire

Abstract

Öz: Bu çalışma, Osmanlı Devleti’nin son asır para piyasalarında yoğunlaşan ihtikâr (vurgunculuk) sorunuyla mücadelesini konu edinmiştir. Bu dönemde ihtikâr, Osmanlı piyasalarında yerli ve yabancı muhtekir (vurguncu) esnaf, tüccar özellikle sarraf ve bankerler için kolay yoldan para kazanmak üzere başvurulan bir yoldu. Bu zümreler meskûkâtı ve kaimeyi devletin belirlediği kurdan ve hatta piyasada şekillenen rayiç fiyattan farklı değerlerle tedavül ettirip ticaret konusu yapmakla haksız kazanç elde etmekteydi. Piyasada tüm dengeleri altüst eden bu soruna karşı, devletin başı olan sultandan kademeli olarak en küçük idari birime kadar idarenin meseleye yaklaşımı çalışmada ele alınmıştır. Hangi yollarla ve ne tür tedbirlerle sorunun üzerine gidildiği ve müdahalenin nasıl yapıldığı incelenmiştir. Muhtekirlere karşı verilen mücadeleyi zorlaştıran ve alınan tedbirlerin etkinliğini azaltan nedenler üzerinde durulmuştur. Bunlar içinde özellikle ceza kanunları nezdinde sorunun nasıl algılandığı ve ihtikârın bu dönemde yoğunlaşmasında kanunların rolünün ne olduğu irdelenmiştir.

Abstract: This study focuses on the Ottoman Empire's struggle against the problem of profiteering in the last century. In this period, profiteering in the Ottoman markets was a way of making money for local and foreign tradesmen, sarrafs and bankers. These groups exchanged money with different values from the real price accepted by the state or the market and made the subject of trade. Thus, they were getting serious and unjust gains. This situation has upset all balances in the market. At this point the study evaluated the management's approach to the problem from the head of state to the smallest administrative unit. The ways in which the problem was addressed and how the intervention was conducted was examined. The reasons that made the struggle more difficult and which reduced the effectiveness of the measures taken against profiteering were evaluated. In particular, how the problem is perceived in terms of criminal law and the role of laws in the concentration of profiteering during this period is examined.
